A couple of weeks ago, the Occupier of the Oval Office threatened hundreds of millions of Americans with a federal vaccine mandate and was visibly and audibly frustrated, not because he actually believed there were people keeping us from being able to move forward, but because his faux-presidency has been crumbling around him for the past couple of months, particularly after the Afghan disaster. When he made that threat, I said that I didn’t fear that what he wanted done would actually be done. And I was right, in more ways than I thought.
Back when I wrote the article, I was under the impression that his administration would actually try to make such a mandate and that freedom-loving governors, AG’s and companies would have to fight it in courts and likely even take the entire matter to the Supreme Court. I didn’t doubt that such massive civil disobedience would be effective. But as it turns out, it won’t even be necessary.
Allow me to explain. In the White House’s COVID plan section, they have a number of action items of what they intend to do or are currently doing. Such items include enforcing a federal worker mandate, whereby federal workers have to get the vaccine (conveniently excluding anyone who works in Biden’s administration and in Congress – you know, the elites); a federal contractor mandate, whereby people who work with the federal government, though not necessarily in it, have to get the vaccine (likely excludes whatever elites would be part of this group); and the infamous national worker mandate for companies with over 100 employees.
This is what’s written in that third plan:
“The Department of Labor’s Occupational Safety and Health Administration (OSHA) is developing a rule that will require all employers with 100 or more employees to ensure their workforce is fully vaccinated or require any workers who remain unvaccinated to produce a negative test result on at least a weekly basis before coming to work. OSHA will issue an Emergency Temporary Standard (ETS) to implement this requirement. This requirement will impact over 80 million workers in private sector businesses with 100+ employees.”
And that is all we have heard of the White House regarding this intention ever since. That paragraph was posted the day after Biden’s threat, on September 10th. Three weeks later and absolute silence on this front from the WH, or any federal agency at all.
The DoL’s website is utterly absent of any and all information regarding a national vaccine mandate, even from the days that the Occupier made the threat and that the aforementioned paragraph was written on the White House website. Even OSHA’s COVID information site says nothing about a vaccine mandate either being worked on or looking to be enforced. The most they say is that people “should” get the vaccine, not that they “must” or are “obligated”, or that they are working towards creating a mandate.
This is important because, again, it’s been three weeks. Nearly a month after this threat from the Occupier himself, and not a single word from the agencies which would work towards such a mandate whatsoever. There is no date for when they even want to begin discussing this matter, let alone when they think they will begin writing or enforcing the rule.
And according to The Conservative Treehouse, “if there was a federal intent to actually force American workers to get forcibly vaccinated as a condition of employment, there would be daily updates from a massive inter-agency network of compliance offices, regulatory agencies and private sector business interests giving updates and briefings.” And this is just regarding the anticipated guidance part aka Step 1, let alone the enforcing of any such actual rule or mandate.
Even if the guy is completely wrong about that assessment, you would think that, following Biden’s threat, either the Department of Labor or its OSHA agency would at least MENTION the intended national vaccine mandate for companies with over 100 employees, even if they haven’t actually begun to work on the rule. And yet, there is absolute silence on that end.
The only thing we have heard of this mandate from the administration at all is in a recent press conference with Jen Psaki, where she was ASKED about it by a reporter and gave the typical vague answer of “they’re looking into it” or “they’re working on it at OSHA”, etc. Nothing concrete or definitive.
Other than that, she said that many companies are already doing their own vaccine mandates “on their own”, and that’s certainly true. Companies like Delta, Apple, Google, and many hospitals throughout the country have executed their own vaccine mandates, and for many of these companies, they are losing workers quickly and having to backtrack on those mandates.
Apple and Google are mostly liberal, so there is little in the way of resistance to the mandate, but airlines have had to undo the mandate, or at least restructure them to be far less strict because of a large loss in employees which they couldn’t easily replace (namely, pilots). The same is happening to many hospitals, particularly in New York, where its lunatic Leftist governor has claimed that they would just replace the unvaccinated workers with either illegal immigrants or NATIONAL GUARD servicemen, as if either of those options were viable in a high-skill job.
But apart from those things, there is absolutely no news about a national vaccine mandate for employers with 100+ employees. Nearly a month without any updates whatsoever in what would be the single biggest restructuring of employment rules in U.S. history. That is proof positive that the DoL and OSHA know perfectly well that they have no legal means by which they can write and particularly enforce such a rule.
Similarly to how it would be impossible to enforce a complete and total confiscation of guns in America, it would be impossible to enforce a vaccine mandate for all companies with 100+ employees. What tools could they even use? What would be the necessary manpower and how would one go about enforcing the rule? Even with gun confiscation, theoretically, all that would be needed would be the police manpower to go house-to-house and confiscate guns (which is easier said than done). What would they be able to do with a vaccine mandate even theoretically? Particularly one which focuses on employees, not people in general?
They haven’t said a word about the mandate because they KNOW they can’t actually work on making such a mandate. Even outside of the legality of the issue (given that this is an illegitimate administration in the first place and Democrats don’t care for the law at all), it’s outright unenforceable. So they aren’t even trying to write rules.
Like I said, I was never afraid that what Biden wanted done would actually be done, but this works out even better than what I had expected. I expected the lawless administration to at least TRY to make unconstitutional rules, even if they knew they were unenforceable, just to show people that they tried to do something. This is even better than what I hoped for.
